Online Pharmacy Terms and Conditions of Use

I. Definitions

• Platform: Online Pharmacy website/application.
• Company: The owner and operator of the platform.
• Pharmacy: Any licensed pharmacy registered and registered on the platform.
• Store/Supplier: Licensed medicine store or distribution company.
• Customer: The end-user requesting the service or product.
• Order: Any purchase transaction conducted through the platform.

Section 1: Special Terms for Pharmacies

1) Registration and Licensing

• The pharmacy must be legally licensed in accordance with the laws of the Egyptian Ministry of Health.
• The pharmacy is committed to providing a copy of: (Pharmacy License - Tax Card - Commercial Register).
• The platform has the right to suspend or cancel the account in case of any proven violation.

2) Pharmacy Obligations

• Commitment to selling authorized medicines only.
• Commitment to the approved official prices.
• Ensuring product validity and quality.
• Compliance with the laws for dispensing medicines that require a prescription.
• Promptly preparing the order within the specified period.

3) Commissions and Dues

• The platform receives an agreed-upon commission percentage from each sale.
• Dues are transferred within a specified period after deducting the commission.
• The platform has the right to deduct any fines or compensations due.

4) Liability

• The pharmacy is fully responsible for the quality, safety, and validity of the product.
• The platform is a technical intermediary and does not bear responsibility for the customer's misuse of the medicine.

Section 2: Special Terms for Stores and Distribution Companies

1) Registration

• Requirement for a license to practice medicine storage or distribution activities.
• Commitment to providing valid legal documents.

2) Obligations

• Ensuring the storage of medicines in accordance with the requirements of the Ministry of Health.
• Supplying products on the agreed dates.
• Commitment to the contractually agreed prices.

3) Returns

Acceptance of returns in case of: (Manufacturing defect - Expiry - Supply error).

4) Legal Liability

• The store is responsible for any non-compliant or counterfeit product.
• The platform has the right to stop dealing immediately upon discovering a violation.

Section 3: Special Terms for Customers

1) Use of the Platform

• The user must be at least 18 years old.
• Entering correct data upon registration.
• Maintaining the confidentiality of login data.

2) Dispensing Medicines

• Some medicines require a medical prescription.
• The pharmacy has the right to refuse to dispense any medicine that violates the law.

Section 4: Privacy Policy

• The platform is committed to protecting user data.
• Data is not shared with any third party except for order fulfillment purposes.
• Data is stored in accordance with the Egyptian Personal Data Protection Law.

Section 5: Limitation of Liability

The platform is an electronic intermediary between the parties. The platform does not bear responsibility for: (Misuse of medicines - Medical errors - Complications resulting from the use of the product).

Section 6: Dispute Resolution

• Disputes are resolved amicably first.
• If a solution is not reached, the Egyptian judiciary is competent to resolve the dispute.
• Egyptian law applies to this agreement.

Section 7: Amendment of Terms

• The platform has the right to amend the terms at any time.
• Continued use of the platform constitutes implicit consent to the amendments.
